Terms of Service

The short version
- Modality is a tracking tool, not a doctor. Nothing here is medical advice.
- 7-day free trial, then $9.99/month. It renews automatically until you cancel.
- Cancel anytime — you keep access until the end of the period you paid for.
- Your content stays yours. You just let us display it in the app.
- Be decent in the Community. Harassment, spam, and medical misinformation get removed.

1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and Modality ("Modality", "we", "us"), based in Chicago, Illinois, governing your use of modalityclub.com and the Modality app (the "Service").
By creating an account or using the Service, you accept these Terms. If you don't agree with them, please don't use the Service.
Our Privacy Policy is part of these Terms.
2. Medical disclaimer — please read this one
Modality is an educational self-tracking tool. It is not a medical device and does not provide medical advice.
Nothing in the Service — not the tracking features, the AI food estimates, the coaching suggestions, the calorie targets, the research summaries, nor anything posted by other users — is a substitute for professional medical advice, diagnosis, or treatment. Modality does not diagnose, treat, cure, or prevent any disease or condition.
Always consult a qualified healthcare professional before starting or changing any diet, exercise, supplement, or recovery protocol — and especially before using heat, cold, hyperbaric, or intravenous therapies, which carry real risks and are not appropriate for everyone. Never disregard or delay seeking medical advice because of something you read here.
If you think you're having a medical emergency, call your doctor or your local emergency number immediately.
You use the Service, and any practice you learn about through it, entirely at your own risk.
3. Who can use Modality
You must be at least 18 years old and legally able to enter into this agreement. By using the Service you confirm that you are.
The Service is not for anyone whose account we've previously terminated.
4. Your account
- Give accurate information when you sign up, and keep it current.
- You're responsible for keeping your password confidential and for everything that happens under your account.
- Tell us promptly at support@modalityclub.com if you suspect unauthorized access.
- One account per person. Don't share your account or let someone else use it.
5. Subscription, trial, and billing
Free trial
New accounts get a 7-day free trial of Modality Premium. You'll be asked for a payment method to start it. If you don't cancel before the trial ends, your subscription begins automatically and your card is charged. One trial per person.
Price and renewal
Modality Premium is $9.99 per month (USD), plus any applicable tax. It renews automatically each month on the same date, and your card is charged, until you cancel. Payments are processed by Stripe.
Cancelling
You can cancel at any time — email support@modalityclub.com or use the subscription management link in your Stripe receipt. When you cancel:
- You keep Premium access until the end of the period you've already paid for.
- You won't be charged again.
- Your data stays intact unless you separately ask us to delete it (see the Privacy Policy).
Refunds
Payments are generally non-refundable, and we don't refund partial months. That said, we're reasonable people — if something went genuinely wrong, email support@modalityclub.com and we'll look at it case by case. Where local consumer law gives you a refund right, that law wins over this paragraph.
Price changes
We may change the price, but we'll give you at least 30 days' notice by email first. If you don't like the new price, cancel before it takes effect.
Failed payments
If a charge fails, we may retry it and suspend Premium access until it clears.
6. Community rules
The Community feed is public. Post things that help people. Don't post:
- Harassment, hate speech, threats, or personal attacks
- Spam, advertising, MLM pitches, or affiliate links
- Dangerous medical misinformation — claims that a protocol cures disease, or advice to stop prescribed treatment
- Someone else's private information, or content you don't have the rights to
- Sexually explicit, violent, or illegal content
- Impersonation of another person or of Modality
- Anything designed to break, overload, scrape, or reverse-engineer the Service
We may remove any content and suspend or terminate any account that breaks these rules — at our discretion, with or without notice. You can report content in the app, and we review reports.
We don't pre-screen posts. Content from other users is theirs, not ours, and we don't endorse or verify it. Treat health claims from strangers with the skepticism they deserve.
7. Your content
You own what you post. We claim no ownership of your posts, comments, photos, or tracking data.
To operate the app, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display the content you post publicly, solely to run and promote the Service. This licence ends when you delete the content, except for reasonable backup copies and anything others have already re-shared.
You confirm you have the rights to everything you post, and that it doesn't infringe anyone else's rights.
If you send us feedback or feature ideas, we may use them freely and without obligation to you. (Please keep them coming.)
8. AI features and accuracy
Modality uses AI to estimate nutrition from meal photos. These estimates are approximations and are frequently wrong — portion size, hidden ingredients, oils, and sauces are genuinely hard to judge from a picture.
Treat them as a starting point, not a measurement. Correct them when you know better. Don't rely on them for medical or clinical purposes, and never for managing a condition where precise intake matters — such as diabetes.
9. Our intellectual property
The Service — its design, code, logo, name, and original content — belongs to Modality and is protected by copyright and trademark law. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your own non-commercial use, subject to these Terms. You may not copy, modify, resell, or create derivative works from the Service.
10. Availability
We work to keep Modality running, but we don't guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of it at any time. If we ever shut the Service down permanently, we'll give you reasonable notice and a chance to export your data.
The Service depends on third parties (Google Firebase, Stripe, Anthropic). Their outages are outside our control.
11. Termination
You may stop using Modality and delete your account at any time.
We may suspend or terminate your account if you breach these Terms, if we're legally required to, or if we discontinue the Service. If we terminate your account without cause while you have paid time remaining, we'll refund the unused portion.
Sections 2, 7, 9, 12, 13, and 14 survive termination.
12. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that any information in it — including AI estimates and research summaries — is accurate or complete.
Some jurisdictions don't allow these exclusions, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law:
- Modality and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service.
- We are not liable for any injury, illness, or harm resulting from any diet, exercise, or recovery practice you undertake — whether or not you learned about it through the Service.
- Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100 USD.
Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence, or for fraud.
14. Indemnity
You agree to indemnify and hold harmless Modality and its operators from any claim, damage, loss, or expense (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.
If you're a consumer in the EU, UK, or another region whose law grants you the right to bring proceedings locally, that right is unaffected.
Before filing anything formal, please email support@modalityclub.com — nearly everything can be sorted out directly.
16. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between us.
- Severability. If a provision is unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a right, we haven't waived it.
- Assignment. You may not transfer these Terms. We may, in a merger or acquisition.
- Changes. We may update these Terms; material changes come with notice in the app or by email before taking effect. Continuing to use the Service means you accept them.
